    Ten months after the Oral Arguments hearing, the Court of Special Appeals opinion {COSA-20180329-Ruling-New-Trial-granted-again.pdf} was published (here). COSA Chief Judge Woodward and Judge Wright agreed that he should have a new trial, although for slightly different reasons to Judge Welch. They confirmed that Gutierrez was obliged to investigate Asia's alibi, (a legal issue) but felt the cell-tower issue had been waived (a procedural timing issue). The third Judge, Graeff, wrote a dissent, which in turn is annotated with footnotes debating (debunking?) her rationale. She previously led the Attorney General's Criminal Appeals team, that would normally have prosecuted this appeal instead of then-Deputy AG Thiru Vignarajah, who is now running for political office in Baltimore.

    The State filed a Petition for Writ of Certiorari. {20180514_State_petition_to_COA_for_petition _for_certiorari.pdf} This is effectively an application to the Maryland Court of Appeals asking for their permission to make a proper appeal. Adnan's lawyer now also has 15 days to file a conditional cross appeal, which, if the State's request is allowed, would allow Adnan to raise any concerns about the elements of the COSA appeal that did not go his way.

    Adnan's attorneys submitted an opposition to the State's writ, with an additional conditional cross petition {20180529-Syed-Opposition-Petition-Cert-and-XPetition-COA.pdf} allowing them to potentially present their own arguments if the case is accepted.

    For now, we wait and see. The COA claims to respond in between 6-8 weeks, or the first half of July. And because one of the three COSA judges disagreed about some elements of the decision, many Maryland legal professionals say it is more likely than normal for "certiorari" to be granted. The MD appeals blog has a post explaining the different legal options that could happen now, and the timings.
