Return to Bail 2017

Exhibits for the 2016 Motion for Release Pending Appeal

After the 2016 Leave to Appeal and Cross Appeal documents had been filed, Adnan's attorneys applied to the Baltimore Circuit Court for bail, and these exhibits were provided in support of the "Motion for Release Pending Appeal" made in October 2016. These were published by Adnan's attorney Justin Brown. The most notable is Exhibit 37, an affidavit from patholgist Dr Leigh Hlavaty confirming that the burial time of 7pm (claimed by Jay and the State) is inconsistent with the findings in the autopsy report and photos. Another significant component is Exhibits 22-33, records of Jay Wilds' interactions with police and courts between 1999 and 2015, demonstrating how the credibility of the State's star witness is now "practically non-existent." Altogether there were 38 separate exhibits of which 16 were new to the public, i.e. 77 of the 318 pages. Also new are: Ex. 1 1999 charging documents (mistakenly showing Adnan's wrong Date of Birth so he was treated as an adult); Ex 5. an affidavit from Professor Douglas Colbert (Adnan's 1999 bail attorney) recalling how a majority of jurors from the 1999 mistrial would have found Adnan not guilty and the impact of racist misrepresentations made by the State at a 1999 bail hearing; and Ex. 6-9 records from Adnan's school, college acceptance and prison work and prison study certificates, demonstrating his character and potential. Some pages had previously been available but not added to the wiki due to privacy concerns.

New pages or files are highlighted, otherwise the links will open another copy of the same file, as duplicates have not been uploaded. Also noted is when an extract was provided in the original Exhibits file. This applies to the larger documents referenced within the Motion for Release. E.g. The Motion refers to several pages in the Prosecution Closing Arguments showing that the State's case was based on incoming calls and a burial time in the 7 o'clock hour. The exhibit (Ex. 10) included only the front cover, transcriber's sign-off and those pages of the Transcript from 25 February 2000.
